A 14ª Câmara Cível do Tribunal de Justiça de Minas Gerais (TJMG) manteve decisão da Comarca de Ubá, na região da Zona da Mata mineira, e condenou uma agência de viagens e uma companhia aérea ao pagamento de R$ 12 mil em danos morais a uma família por constantes adiamentos de passagens. O valor corresponde a R$ 3 mil a cada vítima, sendo um casal e duas crianças.
A decisão prevê ainda pagamento de R$ 3.053,80 a título de danos materiais. O valor total deve ser dividido entre as duas empresas citadas no processo.
Conforme o documento, as passagens aéreas foram reiteradamente adiadas, sempre postergando a viagem e impactando o período de férias da família. A família alegou que precisou buscar nova estadia em período de alta temporada em local turístico, e como houve atraso no retornou, perdeu, dessa forma, a festa de aniversário já previamente agendada de uma das crianças envolvidas.
Diante do ocorrido, a decisão considerou uma situação de aborrecimento, ponderando que se tratava de uma viagem em família, com duas crianças, com atraso de mais de dois dias para retorno.
A agência de viagens, que solicitou recurso da decisão proferida na Comarca de Ubá, defende que “o cancelamento do voo ocorreu por responsabilidade da companhia aérea”, e que somente ela deveria ser responsabilizada. A empresa também defendeu a inexistência de danos morais e necessidade de redução das indenizações.
Ainda segundo o processo, empresa citada alegou que a situação foi causada pela pandemia, durante uma terceira onda. A decisão, no entanto, considera “que a situação alegada não pode ser havida como inevitável ou imprevisível, na medida em que a referida pandemia já assolava o país há mais de um ano, não podendo, portanto, ser configurada como imprevisível, conforme pretende a requerida”.
Os fatos avaliados pela empresa não foram acolhidos pela decisão do desembargador Estevão Lucchesi de Carvalho, que manteve entendimento de 1ª Instância. Os desembargadores Marco Aurelio Ferenzini e Valdez Leite Machado votaram de acordo com o relator.
